These Terms & Conditions (“Terms”) govern your access to and use of our Website, your appointment requests, your purchase of services or gift cards, and your relationship with Evelion. By accessing our Website, requesting an appointment, creating an account, purchasing services, or otherwise using our Website or services, you agree to be bound by these Terms.

If you do not agree to these Terms, please discontinue use of our Website and services.

For purposes of these Terms, “Website” refers to Evelion.com and any related webpages, online booking features, and services operated by Evelion.

 

1. Eligibility

By using our Website or booking services, you represent that:

  • You are at least 18 years of age; or
  • You are between 16 and 17 years of age and have the consent of a parent or legal guardian; or
  • You are the parent or legal guardian acting on behalf of a minor receiving services in accordance with our Minor Client Policy.

Evelion does not provide massage therapy to children under twelve (12) years of age.

 

2. Services

Evelion provides professional massage therapy and wellness services, including services performed at our location and, where available, outcall massage services.

Descriptions of services, pricing, availability, promotions, and business hours are subject to change without prior notice.

Nothing on our Website guarantees the availability of any particular service, therapist, appointment time, promotion, or special offer.

Massage therapy is provided for relaxation and general wellness purposes and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Clients should consult a qualified healthcare provider regarding medical concerns.

 

3. Appointment Requests and Confirmation

Appointments requested through Evelion.com are requests only and are not confirmed until you receive confirmation from Evelion.

Submitting an appointment request does not create a guaranteed reservation.

We reserve the right to:

  • Accept or decline any appointment request.
  • Request additional information before confirming an appointment.
  • Reschedule appointments when reasonably necessary.
  • Cancel appointments due to circumstances beyond our reasonable control, including emergencies, illness, unsafe conditions, equipment issues, or other unforeseen events.

Clients are responsible for providing accurate contact information so we may communicate regarding appointment requests and confirmations.

Appointment confirmations and other appointment-related communications may be provided by email, text message, telephone, or other communication methods selected by Evelion.

 

4. Pricing and Payment

All prices displayed on our Website are listed in U.S. Dollars and are subject to change without prior notice.

While we strive to ensure pricing accuracy, Evelion reserves the right to correct typographical, pricing, or other errors at any time.

Payment is generally due at the time services are provided unless otherwise agreed.

We may accept payment through one or more of the following methods:

  • Cash
  • Credit or debit cards
  • Zelle
  • Venmo
  • Gift cards
  • Other payment methods that may be offered in the future

We reserve the right to decline any payment method that is unavailable, suspected of fraud, or otherwise cannot be processed.

Applicable taxes, if any, will be charged as required by law.

 

5. Cancellation and No-Show Policy

Clients are expected to provide as much advance notice as reasonably possible if they need to cancel or reschedule an appointment.

Failure to provide sufficient notice or failure to appear for a scheduled appointment may result in a cancellation or no-show fee.

The amount of any applicable fee, if charged, will be determined in accordance with our current business policies.

Repeated late cancellations or no-shows may result in limitations on future booking privileges.

 

6. Late Arrivals

If you arrive late for your appointment, your session may be shortened in order to avoid delaying subsequent appointments.

The full scheduled appointment fee may still apply.

If you arrive so late that there is insufficient time to safely provide the scheduled service, the appointment may be considered a late cancellation or no-show

 

7. Refund Policy

Massage therapy services involve professional time that is reserved specifically for each client.

For that reason, completed services are generally non-refundable.

If you believe there was an issue with your appointment, we encourage you to contact us promptly so we may review your concerns and determine whether an appropriate resolution is available.

Refund requests relating to gift cards, prepaid services, or promotional offers will be handled in accordance with applicable California law and our posted business policies.

Nothing in this section limits any rights you may have under applicable law.

 

8. Gift Cards

Gift cards issued by Evelion may be used toward eligible services and products offered by Evelion, subject to any stated terms or restrictions.

Gift cards:

  • Are not redeemable for cash except where required by applicable California law.
  • May not be replaced if lost or stolen unless required by law or otherwise determined by Evelion.
  • May not be resold for commercial purposes without our written permission.
  • May be subject to verification before redemption to help prevent fraud or unauthorized use.
  • Gift cards may not be used to purchase additional gift cards unless otherwise permitted by Evelion.

Additional gift card terms may be provided at the time of purchase.

 

9. Promotions and Discounts

Promotional offers, introductory discounts, seasonal specials, referral incentives, and other discounts are subject to change or discontinuation at any time unless otherwise stated. Unless expressly permitted, promotions may not be combined. Promotions have no cash value and may not be transferred, exchanged, or redeemed for cash except where required by applicable law.

 

10. Outcall Massage Services

Evelion may offer massage services at a client’s residence, hotel, workplace, or another mutually agreed-upon location (“Outcall Services”).

By requesting Outcall Services, you agree to:

  • Provide an accurate service address and any necessary access instructions.
  • Ensure that the service location is clean, safe, sanitary, and suitable for massage therapy.
  • Ensure that pets are secured and will not interfere with the appointment.
  • Provide sufficient space for the therapist to safely perform the scheduled service.
  • Maintain a respectful and professional environment throughout the appointment.

If, upon arrival, Evelion determines that the location is unsafe, unsanitary, inaccessible, or otherwise unsuitable for providing services, we reserve the right to refuse or discontinue the appointment. In such cases, a cancellation or service fee may be charged in accordance with our business policies

 

11. Minor Clients

Evelion provides massage services only to clients who meet our age requirements.

  • Children under twelve (12) years of age are not eligible to receive massage services.
  • Clients who are sixteen (16) or seventeen (17) years of age must have the consent of a parent or legal guardian before receiving services. Evelion may verify that consent by telephone or other reasonable means.
  • Clients between twelve (12) and fifteen (15) years of age must have a parent or legal guardian present during the entire appointment.

We reserve the right to request proof of age, proof of guardianship, or additional documentation before providing services to a minor.

 

12. Health Information and Client Responsibilities

Clients are responsible for providing accurate, complete, and current information regarding their health, medical conditions, medications, allergies, injuries, pregnancy, and any other information that may affect the safe delivery of massage therapy.

Clients agree to notify Evelion if their health condition changes before or during an appointment.

Massage therapy is not a substitute for medical diagnosis, treatment, or emergency care. Clients should consult a qualified healthcare provider regarding medical concerns.

Failure to provide complete or accurate health information may limit or prevent our ability to safely provide services.

 

13. Right to Refuse or Discontinue Service

Evelion reserves the right to refuse, postpone, modify, or discontinue services when we reasonably determine that doing so is necessary for safety, legal compliance, professional standards, or the well-being of the client or therapist.

Examples may include, but are not limited to:

  • Incomplete or inaccurate health information.
  • Medical conditions that may make massage unsafe or require modifications to the treatment.
  • Unsafe or unsanitary conditions.
  • Threatening, abusive, or inappropriate behavior.
  • Harassment or discrimination.
  • Intoxication or suspected impairment.
  • Failure to comply with these Terms & Conditions.

If a session is terminated for one of these reasons, refunds may be denied to the extent permitted by applicable law.

 

14. Client Conduct

Clients are expected to behave respectfully and professionally during all interactions with Evelion, whether online, by telephone, by email, or during appointments.

Clients may not:

  • Engage in threatening, abusive, harassing, or discriminatory behavior.
  • Damage or misuse Evelion property or equipment.
  • Interfere with the safe delivery of massage services.
  • Use the Website for unlawful or fraudulent purposes.

Evelion reserves the right to refuse future services to clients whose conduct is inconsistent with these expectations.

 

15. Photography and Media

Clients may take photographs or videos for personal use, provided doing so does not interfere with massage services, violate the privacy of other clients, or disrupt business operations.

Evelion reserves the right to prohibit or discontinue photography, video recording, or audio recording in situations where it may compromise client privacy, safety, confidentiality, or the professional environment.

Photography or recording for commercial purposes, advertising, or publication requires Evelion’s prior written permission.

 

16. Website Accounts

Certain features of our Website, including future participation in the Evelion Rewards program, may require the creation of a user account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify Evelion promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently or unlawfully.

 

17. Intellectual Property

All content available on Evelion.com, including but not limited to text, graphics, logos, photographs, images, videos, designs, icons, page layouts, trademarks, service marks, and other materials, is owned by or licensed to Evelion and is protected by applicable intellectual property laws.
